Hello my name is***** and I am an attorney with 18 years of experience. Please give me a minute to review your question and provide a response. Did she already pay you?

Customer
But it is also my daughters puppy and she I thought she answered me that it was ok to sell the puppy...but she was actually talking in her sleep. She mumbled yes. And I didn't actually want to give up the puppy.

Did you have any type of written agreement?

Customer
Well I had the puppy for sale on Craigslist. And I willingly had her over just to look at the puppy. I was caught off guard she wanted to take the puppy right then and there. I was crying, and wasn't sure what to do. She sent me $500 over venmo.
Customer
No written agreement. But I had the dog for sale on Craigslist.
Customer
was crying while she was over. I didn't want to sell the dog. I felt pressured.
Customer
I was just feeling overwhelmed.
Customer
She paid me $500 thru venmo

You can try and ask her to give the puppy back and provide a refund, but unfortunately you accepting the money is acceptance of the offer. You may have to try and sue her in small claims court if she refuses.

Customer
My daughter said yes to selling the puppy in her sleep. I went upstairs to ask her and she said yes. But very quietly. In the morning she asked where the puppy went.
Customer
She definitely refuses.
Customer
I even offered to give her a refund. PLUS buy her another dog.

I am afraid you would have to take her to court.

Customer
What are the steps to sue in small claims court??
Customer
what are the chances I would be successful at winning the case in your opinion?
Customer
Are you able to tell me the best way to sue?
Customer
Or go to small claims court?

I think the chances may be tough unless you can show you were forced to sell the dog. You would need to get paperwork from your local courthouse to prepare and file a civil complaint with the clerk.

Customer
Ugh. Yeah that's what I thought.
