Customer: Subject: FOR GUILLERMOHi GUILLERMO,I initially filed by Green Card under EB2 with priority date being Dec 16th 2014. My country of birth is India. But in Oct 2020 , I downgraded my petition to EB3 as an "amended" petition and filed my I 485 petition. Both the downgrade petition and I 485 petition are still pending. Now I observe that the final action dates for EB2 are moving faster. At some point they might reach Dec 2014. If incase they reach Dec 2014 what action I need to take so that I can receive my Green Card? Since I filed my downgrade as "amended" petition , do I need to take any action at this point? Thanks in advance

Hello and welcome back.  I'll be right with you. Remember, if I do not respond quickly, I am NOT ignoring you. I am here. I may just be busy. If you want to make sure that this session doesn't escape my notice, just send me a short reply. Thank you for your patience.

I have to rush to a meeting at the moment, but I think you are talking about interfiling.  Take a look at this article:

Did you read the article?  The action would be to interfile, I believe.

Customer
Since I filed my downgrade as an amended petition, am I still eligible to interfile?

I don't see why it wouldn't be, but remember that it is discretionary, not guaranteed.
