Hello! My name is***** and I am a licensed attorney with more than 19 years of experience. I am here to assist you with your questions. If I do not respond quickly, I promise I will reply as soon as I can. It may take a little time to research and write your answer, I could be helping other customers, or I could be attending to personal clients as I have my law practice. Also, the system may send a message asking if you want to upgrade to a phone call. That is automated. You can ignore it if you like and continue here for no additional charge, or if you find it easier to speak, upgrade as it is usually worth it.

Remember, if I do not respond quickly, I am NOT ignoring you. I am here. I may just be busy. I am confirming by this response that I did receive your question, but if you want to make sure that this session doesn't escape my notice, just send me a short reply. Thank you for your patience.

Sorry for the delay. What U.S. Immigration Law questions do you have for me?

Customer
good afternoon Guillermo
Customer
I had the green card interview yesterday as a spouse of a green cardholder. My(F2A) visa date was current when I applied, so, it was a concurrent filing. The interview went smoothly. Officer asked me if the visa was current when I applied, I said yes. He printed out the visa bulletin and said the visa date is June and then I pointed it's current for Indian nationals(as a matter of fact it's always current for Indian nationals). He said "oh yes" After the interview he said he is approving the I-130 but for I-485 he needs to check if a visa is current. Today the online status for I-130 changed to "case approved" but I-485 changed from Interview scheduled to "under review". Does anyone have similar had a similar experiences and tell me what to expect next? I have read some cases where I-130 was approved on spot but I-485 was denied later. So I am worried.

Sorry for the delay. It happens from time to time especially with new officers and maybe they have to confer with their supervisor before issuing an approval. But are you concerned about something?

Customer
I did not take any lawyers help for filing. Can you confirm for indian nationals the visa date is current and I should not have any problems and also if at all if it gets denied saying my visa date is not current, what should i do next

Here is the link:

The Visa Bulletin (state.gov)

It's confirmed even for next month as well. So this officer may just be inexperienced and is thinking about the Employment-Based categories. What else may I answer for you? I want to make sure you are satisfied and happy with my service to you.

Customer
I have read some cases online where the I-485 is denied by error even the visa date is current. This got me worried. What would be next steps if it happens in my case
Customer
I know I might be thinking too much, but want to be prepared if anything goes wrong

If they deny in error, you would file an I-290B within 30 days of the denial, but unfortunately, that has a cost to it of almost $700.

What else would you like to know? It is important to me that you be satisfied and pleased with the answers that I have provided.

Customer
Can I file I-290B by myself or need to be done through a lawyer? I was said if I-485 is denied, they will revoke the EAD (which I have just received) does it hold when I file for I-290B? Is there anything I can do further strengthen my case
Customer
usually how long does it take to get I-485 approved after I-130 is approved
img

Guillermo Senmartin, Expert

You can file it on your own. You don't need a lawyer to do it. By doing that, you prevent a final decision on the I-485 which keeps the EAD alive. I don't think you need to strengthen your case. Just continue to collect evidence every month that you are in a real marriage and that does not stop until U.S. Citizenship is attained in the future. And I cannot give you a timeframe as to I-485 approval when it probably should have been approved with the I-130. Unfortunately, you just have to be patient. Do not over-worry about this. It should be fine. What other U.S. Immigration Law questions do you have for me? I hope you are pleased with my service. All I want to do is help.

Customer
as of now. I am good. Will get back to you if there is any update.hopefully I dont have to get back to you :)

You are very welcome. Thank you for being a valued customer. My goal is to provide you with excellent service – but that does NOT mean we finished if you need to continue. If you feel you have received anything less than quality service or have additional questions, please continue to ask questions until you are satisfied as there is no additional charge for that. For any situations in the future, please post a NEW session and remember to use FOR GUILLERMO in the message box so that no one else grabs the question. That way, I can become your exclusive immigration consultant. Also, I am not currently taking active cases for representation, but I am accepting certain cases for review. If that interests you, please let me know and we can upgrade to a quick phone call for just a few dollars to discuss pricing. I hope you continue to use Just Answer in the future. It really is a great site where, from the comfort of your own home or office, you can communicate with experts in many different areas apart from Legal like Medical, Tax, Automotive, Computer, Electronics, and the list goes on and on. Thanks again and good luck in all your endeavors!
