If they deny in error, you would file an I-290B within 30 days of the denial, but unfortunately, that has a cost to it of almost $700.

You can file it on your own. You don't need a lawyer to do it. By doing that, you prevent a final decision on the I-485 which keeps the EAD alive. I don't think you need to strengthen your case. Just continue to collect evidence every month that you are in a real marriage and that does not stop until U.S. Citizenship is attained in the future. And I cannot give you a timeframe as to I-485 approval when it probably should have been approved with the I-130. Unfortunately, you just have to be patient. Do not over-worry about this.
