Hello! My name is***** and I am a licensed attorney with more than 18 years of experience. I am here to assist you with your questions. If I do not respond quickly, I promise I will reply as soon as I can. It may take a little time to research and write your answer.

What U.S. Immigration Law questions do you have for me?

Customer
Hi, I just became a US citizen through naturalization. I would like to sponsor green card for my mother. She is here on B2 visa and we extended her stay once due to covid. We may have to extend it again.
Customer
I have couple of questions
Customer
1. Can I file for her green card while she is here and can she stay until it is under process?
img

Guillermo Senmartin, Expert

Yes, you can and she can and is supposed to stay while it is pending even after her "legal" stay expires. You will have to file the following forms: I-130 (Petition for family member), I-485 (application for Lawful Permanent Residency), I-765 (Application for work permit), I-131 (Application for Advance Parole), I-693 (Medical exam that a certified doctor must fill out), and I-864 (Affidavit of support). You will need to file each form with supporting evidence and appropriate filing fees. You can find these forms at www.uscis.gov/forms.

The supporting evidence that you would file would be birth certificates, proof of your U.S. Citizenship, proof of your mother's legal entry into the U.S., and financial documents to prove your income over the last year at least.

In about 5 to 7 months after filing, the work permit and Advance Parole (travel permit) should be issued. About 5 to 7 months after that, the interview should be scheduled (though now it is taking longer, so maybe closer to 7 to 9 months). If all goes well, a few weeks later the U.S. Lawful Permanent Residency card (green card) should come in the mail.

What else may I answer for you?

Customer
2. I think I would have to submit my birth certificate. I was born in India. It has my father's full name but does not have mother's name. Will that work or I need to submit some other documents as well. Also in my name it just says "Baby of Madhu". My mother's name is Madhu

Well, as far as birth records, that is complicated. They are important. Take a look at these links:

Secondary Evidence Regarding Birth Certificate for U.S. Immigration Purposes (immihelp.com)

What else would you like to know?

Customer
Can I provide an affidavit to support the birth certificate? Or any other document?
img

Guillermo Senmartin, Expert

Review the links that I provided. That can be some of the evidence submitted.

What other U.S. Immigration Law questions do you have for me?

Customer
If she has to go back to India while the application is in progress then what happens?
Customer
Does extending her stay on B2 visa due to covid affect her application?
img

Guillermo Senmartin, Expert

She doesn't have to go back and she should NOT go back. If she goes back while the I-485 is pending and without an I-131 Advance Approval first, she abandons the I-485 and would be stuck outside of the U.S. I would not bother extending the B-2 anymore. It would be a waste of time and money if she will just seek a green card now.

What else may I answer for you?

Customer
if its an emergency and she has to go back, she will abandon the current application but can apply again, right?
img

Guillermo Senmartin, Expert

If she goes back before the I-131 Advance Parole is approved, yes and then she would be stuck outside probably for a year or so to do Consular Processing since she isn't normally allowed to "visit" on a B visa anymore.

What else would you like to know?

Customer
Suppose she needs documents to submit for her application and they are in India, she would have to go and get them.
Customer
there is no way to do that
Customer
But she can go once she gets Advance Parole
img

Guillermo Senmartin, Expert

She can go once she gets the Advance Parole approved. But I am sure that she can hire an attorney or someone to get those documents in India if needed.

What other U.S. Immigration Law questions do you have for me?

Customer
Ok. Thank you. Thats it for now. I will review the links that you have given. Appreciate all your help.

Customer
Hi Guillermo
img

Guillermo Senmartin, Expert

Hello.

Customer
I have a question related to what I had asked earlier
img

Guillermo Senmartin, Expert

I don't mind answering 2 or 3 questions about the same case. What else may I answer for you?

Customer
I am filling up I-130 form for sponsoring my mother's green card
Customer
My birth certificate does not have her name so as secondary evidence I want to submit my old passport from India
Customer
there is no field there to accept passport. It just has school records, religious records, affidavits, census etc...
Customer
Also since I am a US citizen now so that passport is not valid
Customer
Can I still submit it as secondary evidence
img

Guillermo Senmartin, Expert

Then don't use the online form. Use the paper I-130 form and submit through the mail. And provide secondary evidence of birth:

Secondary Evidence Regarding Birth Certificate for U.S. Immigration Purposes (immihelp.com)

Chapter 4 - Documentation | USCIS

Customer
I was going to upload it in the census category. Will that not work?
Customer
The link you shared did mention current or expired passport
img

Guillermo Senmartin, Expert

I'm not sure. I never file the I-130 online. I don't like it. I like to send through the U.S. Mail, Certified Return Receipt so that someone at USCIS has to sign it and it gets sent back to me, the signature, not the I-130.

img

Guillermo Senmartin, Expert

And if an old expired passport is not on the list, then that probably won't work. Sorry.

Customer
Ok. Will I be able to track it online after I send through mail?
img

Guillermo Senmartin, Expert

Yes.

Customer
Ok. Thanks for your response

Customer
Hi Guillermo, I have another question on the same topic
img

Guillermo Senmartin, Expert

I've already answered more than 3 follow-ups. I'll do one more as a courtesy, but if you need more help that that, please post a new session and write FOR GUILLERMO.

Customer
Sure. Thank you
Customer
My mother's I-94 was expiring on 02/27 this year but we requested extension before expiry. For the I-130 and I-485 what should I put the expiration date of authorized stay
Customer
02/27 or 8/27 (6 months extra)
Customer
I had filed I-539 which is under progress
img

Guillermo Senmartin, Expert

2/27 because nothing else has been authorized yet.

Customer
I just want to be sure that they will not assume that she is out of status and deny the application
img

Guillermo Senmartin, Expert

It doesn't matter if she is out of status or not. That category is one of the few that "fixes" being out of status.

Customer
ok... got it
Customer
Thanks
