Hello! My name is***** and I am a licensed attorney with more than 18 years of experience. I am here to assist you with your questions. If I do not respond quickly, I promise I will reply as soon as I can. It may take a little time to research and write your answer.
So what is the question, what does the RFE ask for and what does each attorney say?
Guillermo Senmartin, Expert
You are the Petitioner? What is your family size including all dependents? What is your monthly gross income? What did you submit with the I-864 to prove it?

Who is the Petitioner? What is their family size including all dependents? What is their monthly gross income? What did they submit with the I-864 to prove the income?

Well, that's a problem because for a family of three, assuming that you are one of the three, she has to prove that her ANUUAL income is $27,450 or $2288 per month. If she doesn't make enough, then she must look for a Joint Sponsor for the financial aspect of the case. This Joint Sponsor must also file the same Affidavit of Support that she does and submit the same evidence that she still has to submit. The Joint Sponsor can be any U.S. Citizen or U.S. Lawful Permanent Resident that is over the age of 18 that makes the minimum amount. It does not have to be a family member or a household member.
This is the list that I like to use to support the I-864 from the Sponsor and/or Joint Sponsor:
1) Copies of the last income taxes.
2) Copies of the last 1099s and/or W-2s.
3) Copies of the last 6 to 12 bank statements.
4) Copies of the Last 6 to 12 paycheck stubs.
5) Letter from the employer on company letterhead stating salary, position, time with the company and prospects for continued employment in the near future.
My goal is to provide you with excellent service – but we are NOT done if you need to continue. If you feel you have received anything less than excellent service or you just simply have additional questions, please reply back as I am happy to address a few (within a reasonable limit) follow-up questions for you and there is no additional charge. Also, should you need help reviewing documentation or additional services outside of this website, we can upgrade the service to communicate in private about that.

Please re-read my response above. If a Joint Sponsor is needed, which it seems that it is needed, they have to file their own I-864 and supporting evidence.
Guillermo Senmartin, Expert
Most likely the Joint Sponsor since the Sponsor doesn't make enough. But what's the problem in providing evidence from both?
Guillermo Senmartin, Expert
Sure. I would do that. No reason not to. Just make sure that each is labeled correctly, as some evidence for the Sponsor and some evidence for the Joint Sponsor.

You are very welcome. If you need additional help on this case, just reply here and I will help if I can. For any different cases in the future, remember to use FOR GUILLERMO in the subject line and message box so that no one else grabs the question and I can become your personal immigration consultant.
