I have a question about someone doing an AOS based on marriage to a US Citizen about the I-864 form.My question is about On the I-864 page 5, 24a-c asking for total income as reported on most recent three tax returns. The issue that the petitioner did not file for 2019 but is planning to file for 2020. I was wondering if it would be okay to put:A. 2020
B. 2019
C. 2018?The petitioner is planning to file for 2020 but is adamant about submitting it now. I told her an RFE would likely later come for her most recent return and she is fine with that. So is doing the above okay? Because I don't want the RFE coming presumably for the 2019 return (if we put 2019, 2018, and 2017 in 24a-c) when the only one she will be able to provide is the 2020 one.I hope my question makes sense. If not please feel free to ask for clarification. Thanks.

If you have not filed 2020 yet, you should NOT enter the 2020 amount. Enter the total income for the 3 most recent tax years. If you had no taxable income in the 2019 tax year or you earned below the threshold required to file a tax return, you should so indicate.

It appears that you are trying to make the filing yourself. You should consider having a lawyer look at any filing that you plan to make on your own. It can save you time and money. This limited review is called an "unbundled legal service." This is a practice recognized by the American Bar Association and It allows clients who cannot afford a lawyer for full-time representation to get the representation that they may require for part of your case. My concern is that if it is listed as 2019, 2018, 2017 on the I 864--- then when the RFE will come in because there was no tax return provided, the RFE will assume that they are submitting the 2019 one when she didnt file for that year. She is planning to file the 2020 one soon. Do you think it will be okay to submit the 2020 tax return (let's presume the RFE will come around June) at that point? I was thinking if 2020 is put on that I 864 form, at least there will be no confusion as to which "most recent tax return" is at issue in regards ***** ***** RFE.This person did not file in 2019 and will only file the 2020 return in a couple months. She is adamant about submitting the case now despite the risk of the RFE coming in because of lack of most return tax return.

If your income comes from salary and/or independent contracts, you can include the W-2s or 1099s with your filing. I do not think that it is a wise strategy to fail to include required documents with your initial filing. While we would hiope that the Biden-directed USCIS will be more sympathetic, they do not have to issue an RFE could deny your I-485 application.

If the only tax returns that you filed are 2018, 2017, and 2016, then list those and include a copy of the 2018 return. You should also explain in Part 11 (page 10), referring back to Part 6, item 24, that you will be filing the 2020 soon and attach the W-2s, 1099s, etc, that you ave for 2020.

Again, I recommend that you seek the help of a lawyer.

you are saying include the 2018 return and w-2? And that can avoid an RFE since the requirement is to provide most recent tax return. That language can seemingly infer to file the most-recently filed tax return, correct?

Yes, you must include your most recently-filed tax return. In your case that is 2018. You should also file your 2020 W-2 and/or 1099s as an attachment in the way that I suggested. Does your 2018 income and 2020 income meet the I-864p income guidelines?

For some reason I am getting different answers from you and another immigration lawyer. The other lawyer said that the i-864 mandates to write 2019, 2018, and 2017 period.You suggested to write in 2018, 2017 and 2016 since in 2018 i did file.I am a little confused. How confident are you in your answer?I think I am more inclined to put 2019 (blank because did not file), 2018 with the total income reported, and 2017. My reasoning is that on pg 5 of the I 864, it says "my total income as reported on my federal income tax returns for THE MOST RECENT THREE YEARS WAS...."that last part seems to infer most recent three tax years , not three most recent filed tax year returns as you suggest.What do you think ?

I have re-read the instructions and I agree with my colleague. You must report taxable income from the 3 most recent taxable years. In your case, it would be 2019, 2018, and 2017. Since you have no income to report for 2019, you would enter "0" and then attach an explanation in Part 11. See I-864 Instructions at pages 8-9. I am sorry for the confusion.

But you have not answered my question. Is your income going to be sufficient to meet the income guidelines? If not, you will need a joint sponsor who does. This sponsor must be a US citizen or permanent resident.

We have a joint sponsor.Let me ask you this. Since an RFE is likely to come because the 2019 tax return was not filed and we cant submit that "most recent" tax return and at that point in time about four months from now when we get the RFE --- I would have filed a 2020 tax return--- do you think it would be an issue to submit the 2020 tax return as a response to the RFE instead of the 2019 (which would be listed on the I-864 as most recent tax year at the time of the filing). Do you see what I am saying? Would submitting the 2020 tax return cause any confusion in response to the RFE since we are filing now and on the I-864 the most recent tax year listed will be 2019?

If you get an RFE, you should respond with the 2020 tax return and an explanation that you had no taxable income for 2019. If you have a qualifying joint sponsor, this discussion will not matter because USCIS will be relying on the qualifications of your joint sponsor.
