Customer: FOR GUILLERMOHello sir. There is an older gentleman doing an AOS based on marriage for his wife. He has not filed tax returns in several years because he is retired. We wrote an explanation, as he describes, he has not files tax returns in three most recent years because all of his income is disability income which is not taxable income. The question I have is on the I-864 page 5 #24a-c ---- should we just put like this below and just include the explanation on the last page2019: ______(blank)
2018: ______(blank)
2017: ______(blank)The thing is, he does have disability income but like he explains he doesnt file tax returns. Not sure if we are to leave the "total income" column on pg. 5 blank as above? It does say my total income "as reported on my federal income tax returns for the most recent three years."

Welcome back and thank you for requesting me by name. Unfortunately, I'm not an accountant. You need to speak to an accountant to see if he was really exempted from filing or not. But I to agree that he should leave blank and write a letter of explanation.

What else may I answer for you?

Customer
Is it ok to include the letter of explanation on the last page of the I-864 or should we include a separate letter attached to the i-864?

I would actually do both, a cover letter explaining and doing it at the end as well. Let me know if you need anything else, but please do not forget that positive rating. Thank you for your understanding!
