On Oct 11 2021 my petition for a fiancee visa was received by the USCIS. Rapid Visa helped me fill out the forms. At that time, I was told it would take 5 to 7 months for the USCIS to process my petition to give my fiancee and her 2 boys visas to come to the USA from the Philippines. Nearly 1 year has passed. I have not yet received my NOA2. The processing time has slipped from 5 to 7 months to 13.5 months to 19 months. My fiancee's oldest son will soon be 19 and I don't trust the information I get from Rapid Visa or the USCiS. I need help. I need to know if I should abandon the K1 Fiance visa and switch to the spousal visa to insure visa's are issued soon, before my future son-in-law turns 20. Can you help??? Desperate in Vallejo, CA
JA: What steps have you taken? Have you filed any paperwork with the U.S. government?
Customer: YES, the I-129F fiance visa for my Philippine fiancee and her 2 boys (13 and almost 19). It was received by the USCIS in Tx on Oct 11, 2021
JA: Have you talked to a lawyer about the K-1 visa?
Customer: No, but I have used Rapid Visa to fill out the forms and have them verified before submitting them.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: Yes, I am ready to fly to the Philippines and get married if it will accelerate the process. K-1 or CR1 ??? Another Key Point: My fiancee is a Physical Therapist and wishes to be employees ASAP to help raise her boys. The spousal visa seems to shorten the time to get the SSN and Green Card. Perhaps there are fewer applicants for the Spousal Visa and perhaps its faster than the K-1 Visa. Can you help me decide which way to go to both get my fiance to the USA ASAP and enable her to work? I feel Rapid Visa lied to me when they told me it only taks 5 to 7 months to get the visa. Maybe out of ignorance or because things changed, but in any case they didn't let me know about these delays.
