Okay thank you.   What the is the alleged basis for termination?

Customer
They're claiming failure to participate regularly in court ordered treatment program
Customer
When in fact I did a program graduated successfully they didn't have a problem with me in that program when I was in it and then after I graduated the program they said it doesn't qualify to their standards
Customer
also this case has been going on for 2 years
Customer
Hello are you there

Customer

Customer
Will I ever be speaking with you in person or over the phone

Did you use a court approved provider to get the treatment?

img

TraceyLaw, Expert

You should be prompted for a phone call on your end.  I can't initiate that.

Customer
no I did not use a court approved provider because I was not aware that that needed to happen my social worker was very vague and just said I needed to do a program she never specified whether it was inpatient outpatient for how long nothing she just said do a program and so I found one and I went and she knew where I was while I was in it and didn't have a problem with it

You've been misinformed, you are required to get all services from court appointed providers only.  This is not a basis for TPR however.  How long has your child or children been in care?

Customer
for 2 years
Customer
another issue is that my child is placed in Sacramento County foster care at the time that this took place I lived in Rio Vista California that's Solano County
Customer
I wonder why the social worker would allow me to go through that program and waste my time and days of my life with my child if it wasn't Court approved
Customer
in fact while I was currently in the program I would have phone calls with my social worker and we also had a phone meeting with my social worker and her supervisor saying that the program that I was in was okay and they were going to accept the drug test there in court

TraceyLaw, Expert

They should not and as I stated, that wouldn't be a basis to terminate your rights.  If you are doing the program as agreed, then that is not the basis of the TPR.  Do you have the petition they filed?  The basis is stated there.

Customer
i can't find that paper
Customer
I just need to know if someone is able and willing to take my case pro Bono and represent me

TraceyLaw, Expert

Good morning, finding pro bono attorneys for matters like this is difficult.  I'm still searching, thank you.

img

TraceyLaw, Expert

Okay thank you.  Finding a lawyer to go against CPS for free wasn't going to be likely in any state but I wanted to give it a look anyway.  Sure enough, I got no luck.  I found a LOT of resources but none of them for TPR.  Where I practice, a parent is entitled to counsel but that is a matter of state law and CA does not provide counsel for parents in this situation.  For these reasons, I highly suggest you make contact with this firm here who provides a free consultation for CPS cases.  You didn't give your actual location w/in CA so if this lawyer is not located near you, give me the city and county and I will see if I can an appropriate attorney closer to your location.  The law firm's page is linked below:
