JA: What steps have been taken? Have any papers been filed in family court?
Customer: my mom and dad were married in louisianna sep 1977, but he was not divorced from his exwife in texas till may of 1978. my dad passed away saturday and we need to fill out the death certificate.
JA: Has he talked to a lawyer about this yet?
Customer: the exwife thinks that she is still married to my dad, but my mom says that she is married to him. the funeral home states that the ex wife is just that, the ex wife, but unsure about the marriage to my mom. since the divorce was not final. how does this work
JA: The Family Lawyer will be able to walk you through that. Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.

According to Louisiana, your mother did not legally marry your father.

Customer
The marriage certificate from Louisiana says that they are.
Customer
This is all so confusing to me. I have lived the last 46 years believing they are married
img

Phillips Esq., Expert

According to Louisiana law what she has is an absolutely null marriage.
Customer
Wow
Customer
Is that based on 2022 laws or 1977 laws

See Louisiana Civil Code Articles 88 and 94:

I can only access the present laws.

Phillips Esq., Expert

However, if there is a marriage certificate, you can use that evidence of marriage.

The ex-wife is not involved here.

Hello. I just want to add the following:

Absolutely null marriage “produces civil effects in favor of the party” that married in good faith without knowing that the impediment to the marriage has not been removed.

img

Phillips Esq., Expert

Here, your mother married your father without knowing that he had not divorced his previous spouse.

img

Phillips Esq., Expert

So, your mother, the party who contracted the marriage in good faith without knowing that your father was still married at the time of the marriage will be treated as married to your father--it “produces civil effects in favor of” the party that married in good faith.

img

Phillips Esq., Expert

So, your mother would be treated as the legal wife of your father. See Louisiana Civil Code Article 96

https://law.justia.com/codes/louisiana/2021/civil-code/article-96/

Customer
But what does this have to do with or mean in Texas
img

Phillips Esq., Expert

This only pertains to your question as to whether to list your mother on your father's death certificate.
img

Phillips Esq., Expert

I wanted to find something that backed up my previous answer that yes in fact you can list your mother on the death certificate as the wife.

img

Phillips Esq., Expert

The issue of whether the marriage is legal or not  is pursuant to Louisiana law and not Texas.

Customer
Alright thank you
