Customer: Long story but here’s the gist… My mother-in-law was supposed to come and live with us because we noticed she was getting a bad memory and judgment and things of that sort so from experience with my grandmother I know she needed to get checked out for dementia because it was definitely a pretty quick onset. And then good old Covid hit me as a family of eight lost our home vehicle‘s literally everything including my children’s memories from growing up just now getting back on her feet therefore I can imagine everything changed there was no way possible for us to do that because of it. During this time her sister and her husband of which have called many many people out of money and you name it have been in her ear telling her people are stealing from her and if you know anything with dementia it Hass to do most of the time with possession of people stealing possessions and such and it’s something that they cannot get over nor quit thinking about 24 seven basically. They now from what we heard are trying to get power of attorney over her and keep her basically locked up in the bedroom she has no contact with anyone they refuse to let us speak to her or even do that we’re calling as well as my husband and stepbrother because we all know what they’re doing. Can you tell me the best route for me to take in order to be able to get in contact with her and get her here with us to take care of her or anything of the sorts? If we could only get to speak to her she would not refuse she’s been wanting to be here with us she is just being told that we don’t want her in this and that we’re just gonna put her in a home which is utter BS because I took care of my grandmother why would I not take care of her.

Gosh I am so sorry.   There are a couple of options. One can file a report with adult protective services.    They will investigate and remove her if there is abuse or neglect.  

The second is to petition the court and they can grant you guardianship which would give you and not her sister the power and co trip over both the individual and the estate.

Ok so it’s a simple petition to the court she would be closest too? Are there any certain or specific papers I need to file with the petition?And see, that’s just it… anyone should see it’s solely about her health and the best thing for her because there is absolutely no estate or money involved besides her sister taking every penny of her very little bit of social security that she gets.

Oh that is upsetting.  Yes the court in the county where she lives.  The clerk may have a packet of preprinted forms to help with the paperwork.  The very best to her and I’m so glad she has someone looking out for her.  Please let me know if you have any other questions please
