Customer: My ex and I have 50/50 joint legal joint physical custody of my daughter . I accidentally got our weeks mixed up and didn’t get her last week like I should have. I only realized this today when I went to get her from school and she wasn’t there. I called her mom and her mom said I “abandoned her” and for the whole week that should have been mine, she never reached out to ask me if I was picking up or if I got my weeks mixed up. My question is, I made an honest mistake and she kept her intentionally when she new it was wrong and never called me. Can this come back on me? On her?
JA: Is there a custody agreement in place? Does it address educational decisions?
Customer: Yes. This is a time issue. Not an educational issue
JA: Has there been any mediation on this issue?
Customer: no
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: We have an upcoming court date and want to know if this will show more of poor communication and malice on her end or if it could come back on me? It was an honest mix up

sorry your going through this situation. From the facts you gave, this sounds like a honest mistake and as long as you have been reliable in the past, I don’t think the judge will be to concerned.

Customer
We have NEVER missed a time in this manner. Mom has a history of custodial interference and this was truly just a mix up. Do you have an opinion on how this will reflect on mom? We were supposed to pick up on Thursday and have her for 5 days and when my daughter realized I wasn't there, the school called mom for pick up and mom never contacted me. She proceeded to pick her up for the 5 days without a single word to me

Well, if she has a history of being difficult , then it will probably not look to good for her, but the judge won’t punish her for this one time, I don’t think.

Customer
That's fine. Not looking for her to be punished for it. When I called her today wondering why my daughter was not there for me to pick up, she told me I "abandoned her at school", when it was an honest mistake that has happened this one time. So I just wanted to get an opinion on whether this will be an issue for me in an upcoming court hearing
