You would file for a motion by including an affidavit that explains to the court that you are asking for a court order to grant you relief and ordering a review of the parental rights including custody, visitation and child support for your child. You would explain the reasons why you need judicial assistance. You would serve the motion on the father. Then you would need to file an affidavit of service explaining the time, date, manner of service (By mail, By personal service, By process server etc) The respondent would be able to put in opposition. After a judge can decide the motion based upon the papers or ask both parties to present facts for a hearing.

You should consider hiring an attorney who is an expert in civil litigation matters - especially involving . Hiring a private attorney will go a long way in giving you professional representation who can look at your case, form a strategy and forward your best legal argument, It will also serve to make the judge and parties involved take your position more seriously and give you a greater chance at success
