What sad situation.  You not being a parent, don't have any rights to the children.  Your best option is to work through CPS.  You should and have a legal duty to report her to CPS.  You can let CPS know you will be willing to take the children.  They will investigate the situation with the children and do a home study on you to make sure your ok.  If it's as bad as you say with her and your ok, they can place the children with you.  Parents have a superior right to their children but in a situation like this, the best interest of the child will prevail
