Customer: Domestic Violence is involved. support arrearages are involved as well . history of support orders go back 10 years. i have solid proof of fraud trailing back to its origin. opposing lawyer has violated many codes of conduct and ethics.. has taken advantage of me when i was self represented, and strategically consumed/wasted time arguing and challenging every single point possible with lawyer i now have, burning up my retainer on insignificant nonsense. I am totally discouraged with the system and completely defeated. unable to protect or provide for my child

well i have a few. my case is very old. i requested modification of support and custody due to ongoing abuse to my son by his father. there is a history of DV in our file. there was a current EPO issued as result of the most recent incident which brought me to file for mod's. the commissioner assigned to hear our case in court admittedly did not read my papers which detailed every incident of abuse from the last 5 years, included police reports, pictures, past restraining order... completely disregarded, overlooked, i dont know but i read there is protocal which is supposed to be followed for dv cases in family court to ensure safety etc of the child. it was not by any means. she ordered visitation after the first hearing, regardless of all the proof presented, and said that i am not allowed to have any contact with my son during those visits.

It sounds like you're not happy with the commissioners' decision. If you're not happy and you have true appealable grounds you can file an appeal to the case but in most cases the commissioner will have broad discretion so there's not much you can do if you disagree with the decision. To give yourself the best chance you want to hire and it appeals attorney to review and give you further advice. Any other questions?

that was 1/21/2020. my son refused the visits, he wants no part of his father as he is accusing my son of lying rather that being accountable for his actions. as well as accusing me of lying and manipulating the situation. a ppa was scheduled, report was given to the court which in every way confirmed everything me and my son have been saying. he recommended visits be at my sons discretion and that he not be forced to rebuild the relationship until he is ready etc. That was disregarded as well, keeps on dragging the case out without hearing the support issue still. refused to allow my son to be heard in any way after multiple requests. he is now 16. she has had us continuously return to court, go through all these changes, counseling, ppa , minor counsel, mental assessments, all for the purpose of getting dad back in his life. it is absurd. now it has been going on 18 months, his dad has moved to georgia and she still will not just make a decision and let it be done. my lawyer says there is nothing i can do. is there a rule that says there has to be a resolution in a timely manor?
