I have a court ordered parenting plan with my ex wife. She lives in Arizona and I live in Utah. Our parenting plan States that for visitation the parents are to meet halfway for drop off and pick up. If one parent decides to fly they are responsible for the flights. If one parent drives the full way to pick up the other parent is responsible for getting the children back home. I drove the full way to pick up my children for Winter break. My ex wife who is the custodial parent advised me that she is no longer participating in the parenting proud with the drop off and pick up. If I do not take the children Back since that is not my responsibility, are there any legal repercussions that could happen to me? She has blocked me on her cell phone so I no longer have a way to communicate with her. She sent my mom a message saying that she was taking me to court for mediation and that my mother needed to have the kids back to Arizona by January 1st. I don't want to get charged with kidnapping or have any negative repercussions result from this issue. Could you please advise me what uptime I available in this situation? Thank you
JA: What steps have you taken? Have you filed any papers in AZ family court?
Customer: No I am not sure what to do, she has never refused to participate. And since we live in different states I want sure which state I would go to.
JA: The Family Lawyer will be able to walk you through that. Have you talked to a lawyer about this yet?
Customer: No, all this just came about today.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I can't think of anything else at this moment.
