Customer: My grandfather is currently in hospice. He has a last will and testament where he has passed on his real estate and possessions to me. He also signed a POA appointing me as POA back in May of 2022. All witnessed by 2 others and notarized in front of a notary. We just now are finding 3 life insurance policies that he has that he was unaware of. We're pretty sure the beneficiary on his policy is his deceased daughter and would like to make changes to the benificiary to avoid a misallocation of funds.

Generally, a Power of Attorney does not give you, the agent, the authority to change the beneficiary on a policy.

He's 96 years old and very weak. At this point I have taken over all of his affairs. He appointed me to do so back in April. He assured me he didn't have any policies on himself but we are just finding 3 policies in his name.

Most likely he named his daughter my aunt as beneficiary but she passed away many years ago. Only one of her children is active and present with me through this process. The others are in rehab & prison. We're not trying to cut them out but more we want to properly be able to allocate any funds that may come from the policy

The insurance company is in the process of sending me the amount of the policies. They couldn't tell me on the phone they could only mail to the address on file. Can a lawyer expedite the process or do any better than I'll be able to do on my own?

I don't think a lawyer will be able to accomplish anything more than you can.

Ask the insurance company to send a beneficiary change form.
