My brother made a proposal through his lawyer that he will buy my 2 sisters and my half sister and her daughter out for 20.000 .however he decided to çlose me out of the proposal and not offer me NO MONEY. THE WILL STATED I AM1/10 ONWER.WHAT IS MY RECOURSE. CAN THE LAWYER AND MY BROTHER DO THAT

Customer: No his lawyer contacted me and my sisters however his lawyer got back to me to let me know my brother will not extend the proposal to me. I know u can't just discard an individual of a will because u feel like it

Customer: No I am trying to see what is my recourse on this situation. Help

Customer: The original will that my dad showed me when he was alive is not the the same will that exist now. I think my half sister went there and while he was on his death bed change the will . I suspect foul play.But I am very sure he did not want my brother to have the house.

It wouldn't be mandatory for your brother to buy you out if he only wanted to buy out the other shares to give himself a 90% interest in the house.

But even with only 10%, you have every right to use and live in the house if you choose to or sell your interest to anyone who might want to buy it.

So even if he owned 90% you still both have exactly equal rights to use and enjoy the property.

Further, if you really wanted to hold his feet to the fire, as an owner, you have the right to file suit for "partition", which is where a judge orders a sale of the entire property at public auction. So if he wouldn't buy you out, you can force a sale of the entire property at public auction and cash out your interest that way.
