Is there a last will and testament?

img

EvanG329, Expert

Also do you know an approximate value about how much the value of all of the assets would be?

Customer
my grandma did have a will however it has been 3 years since her passing. I am the executor and trustee and also a beneficiary of the estate that had a verbal agreement with the other beneficiaries that we wouldn't go to court until we pay of the remaining balance of the reverse mortgage loan our grandma has taken out on the home but now things are getting out of hand and one of the beneficiaries are trying to take over everything and kick people out illegally

I understand.

EvanG329, Expert

it sounds like you will need to file the will and get appointed as executor to be able to legally take control of the house for the next steps.

Here is an overview and the forms and steps to do this.

Customer
I am actually in Sacramento, ca
img

EvanG329, Expert

Here is the Sacramento County site that has more specific instructions on where to file.

Customer
that says Santa Clara county
img

EvanG329, Expert

The forms in the other link for Santa Clara are statewide forms and will work in Sacramento too.

img

EvanG329, Expert

They just have a better instruction set and list the forms.

Customer
awesome thank you so much. do I need to complete all of those forms and submit or just petition first
img

EvanG329, Expert

Yes. You would need to complete the initial forms/petition and take the will and death certificate to court to file. The others can be completed later.

Customer
the Santa Clara is so much easier to understand than Sacramento. thank you again

Customer
hello so I came to the law library to get help filing for probate paperwork and the told me usually it is is a living trust and will it doesn't have to go to probate
img

EvanG329, Expert

I understand. If there is no assets that have to be in probate court to change the title then you can begin transfer as trustee.

Customer
what does that exactly mean?? so if the home is still in my grandmas name I would still need to go to probate court. I'm sorry I just don't understand how this goes please bare with me
img

EvanG329, Expert

Not a problem. In this case you may need to probate the will to move everything to the trust if the house is in her name alone.

img

EvanG329, Expert

It is a simplified process that will require you to open the estate still.

Customer
can you show me on the probate paperwork what portion I need to fill out
img

EvanG329, Expert

I cannot legally give guidance on what to put in the forms, but they are straight forward.
