I think I may have a wrongful termination case but I am not sure, "relapse of mental health symptoms" causing me to "not

Expert's Assistant chat
Customer: I think I may have a wrongful termination case but I am not sure
JA: Just to confirm, were any reasons given as grounds for the termination?
Customer: "relapse of mental health symptoms" causing me to "not possibly be able to provide quality care for your patients". I had to take a week off due to PTSD symptoms acting up (which was approved by employer) to receive care and got fired upon return.
JA: What kind of workplace is this (private sector, public sector, etc.)? How many employees?
Customer: Private I believe. Discovery Behavioral Health. Over 1500 employees
JA: Where are you located? Workplace termination laws vary by state.
Customer: Washington State
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I don't think so. They cited a policy when letting me go, but have stonewalled me every time I have asked for a copy of it

What was the reason that you were given for the termination?

Customer
I worked as a psychotherapist remotely for this company. I had to take a week off due to PTSD symptoms acting up due to life stressors such as divorce (which was disclosed to and approved by employer, medical documents were provided) to receive care and was terminated upon return. The reasoning given to me by HR was "relapse of mental health symptoms". They cited a policy that they have that allows them to terminate due to this, but I have been stonewalled each time I have asked for a copy of it to review.HR also verbalized that "Even so, we noticed your work performance declining", but this was never communicated to me as I have no recorded history of poor work performance, write ups, or verbal discipline at the company. This caused many hardships for me both mentally and situationally as my husband had recently left me and my children and I was pregnant at the time (and still am)

I am sorry to hear of this issue. If you believe the termination was based on discrimination or retaliation, you can make a complaint with the EEOC at EEOC.gov. You will want to file the complaint and the EEOC will investigate your complaint. If they find that it is founded, they will issue you a right to sue letter. You can then use the right to sue letter to sue your ex-employer. You will then want to locate a local attorney to assist you in the lawsuit.

If at anytime you need an attorney to assist you, you can find a local attorney by contacting your local bar association and asking for a referral to one. You can also contact your local legal aid society as they offer free and low cost services in these types of cases. Another good resource is to contact your local law schools as they often have clinics with attorneys that will assist in these types of cases. Again, I am sorry to hear of this issue. If you have any follow up questions, I will be very happy to assist you.
