Customer: I have been at same pain management clinic for 5 years. No failed tests ever. I am on lowest dosage of tramadol and lowest patch.Two days ago, they told me that I failed a test 2-3 months ago at some point.
I had been there 2 times since that test. I tested for crack. I never do illegal drugs. They said I could continue there for procedures. But NO meds. Scheduled me with an appointment there with their suboxone doctor. I am still in shock.
For 15 years I was the go-to person at alabama power for drug tests. 60+ times. (I suspect to cover for other coworkers never tested). The highest panel tests.
Worked nuclear also. Also worked nuclear directly with 10-20 drug tests.The only time that I have EVER been told I have failed a drug test was yesterday.I backtracked what I was doing months prior. There was an homemade aftercare tattoo product i bought at a festival 2 days before the test.Also, I literally bathe in a 3 tier combo of lidocaine, prilocaine, benzocaine for tattoos. Both before and during. I am at tattoo shop every 5-9 days AlWays. My body is covered.
I doubt anyone is exposed to this much.I sent to their portal, faxed, and fedexed all documented above.
Including
1)phone pictures of products used. 3 tier pain cream + festival aftercare cream.
2)my body tattoo work that month. It is massive.
3)pictures of the outdoor festival from phone with dates of one day before drug test 4)festival website showing date of art festival.I asked for reconsideration from the 10 week ago drug test.Does this sound right or reasonable at all to you?
JA: Did you request a retest? What happened?
Customer: They said no retest. Was too long ago.
JA: Have you talked to an AL lawyer about the drug test?
Customer: No

I’m sorry to hear about this. So you tested positive for illegal drugs yesterday, is that right? Is this pain management clinic a private clinic or one you're required to do through a judicial process/court case?

Private. Alabama pain physicians. I also get 6 back procedures done a year there also. In fact, I was there twice AFTER my false positive drug test.
There is no court case as I am 49, clean as a whistle. Like I said, nuclear clearance. 15 panel tests for 15 yrs. (around 60 times) + 2 other years (10 times)
No positive tests for 4 years at alabama pain.
I first went once a month. Then they prescribed 2 months worth. I went once every 2 months.
This is first positive ever in whole life.
No misdemeanors. Felonies.

Sorry. I was TOLD that I tested positive at my regular appmnt on 7/19. For a positive test given a few months in the past. They did not tell me when.
My calendar shows I was there 7/20, 7/25, 9/7.

Their response was 1) I could not retest. Because it is too far removed from my positive test 2 months ago.2) I can continue with them for my back outpatient procedures.3) NO more opiates prescribed again.
I am on 2.
The lowest level pain latch, and the lowest level and amount per day of Tramadol.4) i could withdraw on my own.5) seek another pain clinic6) see their suboxone doctor.
Scheduled tomorrow morning at 9am.

All of this is indeed strange to me.
1)Failing a test I have never in 49 years.
2)No retest given since the positive test was 2 months prior. Even though first letting me know 2 months later. They apologized for this.
3) No options except withdrawal meds.
4) Since it was for crack cocaine, it is more serious they said?

I have had excellent 100% relations with AlaPain for 5 years. The main doctor talks to me often of my tattoos and other things. Does my back outpatient procedures 16+ times.
He is not the one who spoke to me on 9/19. Not that any of this pertains legally. It is perplexing.

Apologies but this thread is for one main question and some related follow-ups. I'm unable to review your documents. You can definitely negotiate with them to get the specific test results, in order to see the date/time you tested positive. You can also ask them for their internal process for if it's something that you're able to appeal. Unfortunately as it's a private clinic, they are allowed to use their guidelines/rules, as this would violate their procedure for prescribing medication. Outside of that, you would need to find a new clinic.
