Expert's Assistant chat
Customer: Good morning. My wife have been having a hard time at work. She has been working as a dialysis tech for the past 6 years. She is loved by her patients and highly requested from patients to care for them over other peers. She gets call outs on her time off to come back to work to stick patients with their IV's because some of her peers are not capable. She just found out that she is the lowest paid tech at the clinic even though she has been with company the longest. When she presents her concerns to HR, they always refer her back to her clinic manager that is causing the problem. She feels that the system is corrupt and that she is facing dissemination on a daily basis. Is there another option other than quitting and find another career?
JA: Was this discussed with a manager or HR? Or with a lawyer?
Customer: It was discussed with the manager and she denies all allocations.
JA: Is the workplace "at will" or union? Is the job hourly or salaried?
Customer: the job is hourly
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: Yes, the manager said because she had to take of work for the birth of our children, that was covered by FMLA, she was not eligible for a raise. Customer: Chat is completed

  1. Texas is employment at an employment at will state.  This means that absent  an employment contract to the contrary, either party in an employment relationship may modify any of the terms or conditions of employment, or terminate the relationship altogether, for any reason, or no particular reason at all, with or without advance notice, except due to race, religion, gender or disability, or refusing to comimit a crime

  2. Thus, inTexas, employers may develop and change personnel policies, reassign employees, and change such things as work locations, schedules, job titles, job descriptions, pay, and other aspects of jobs whenever they want.  There is no right to be baid what otheres are paid.

Customer
Ok. Even though they have less experience and time served with the company?

Makes no difference. There is no right to be paid the same or more than anyone else, absent an employment contract which has a clause about that.

It is not unlawful discrimination, unless based on race, religion, gender or disability.

I know this is not what you were hoping to hear, but I have to tell it like it is.

Does the above answer your question, please?

Customer
No is neither of those options it really just comes down to a personal issue between the clinic manager and my wife and there is nothing that can be done to be treated fairly. Thanks for the insight.
