Customer: I filed for Fl unemployment in 2021. I was upfront with all info asked from me. They approved my unemployment and started paying me. Now, they are saying I wasn't eligible for it and they want me to pay over $3000 back to them. I definitely cannot afford that. I'm having hard enough time feeding my family. I reside in TN now for a year. Can they make me pay that back even though it wasn't my fault?
JA: Is your employer claiming the termination was for misconduct?
Customer: No. I did quit my job due to relocating to another state. I even asked the company if I move could I still work for them. I never received a response. Anyway, the fact is, I had no other choice to move. My husband was taking early retirement and move here to TN.
JA: Have you talked to a TN lawyer about the unemployment eligibility?
Customer: Why would I?
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: No

I’m so sorry that you are having trouble with unemployment . You must be so frustrated. So, are you stating that you applied for unemployment after voluntarily quitting your job?

Customer

I am so sorry. Unfortunately, you are not eligible to receive benefits when you voluntarily quit a job. Generally, unemployment benefits are for individuals who lose their job through no fault of their own. If you quit, then you wouldn’t be eligible. I am so sorry. You could try asking them for a waiver since you can’t afford to pay it back. It would be up to them to decide whether they would accept it.

Customer
Why would they allow me to collect for 3 months unemployment when I wasn't eligible?
Customer
Correct me if I'm wrong, but it used to be that if you quit your job, they would still approve unemployment benefits but you had a penalty of them holding week b4 they would give it to you.

No, that isn’t correct. If you were laid off or fired you would be able to collect benefits. However, if you quit voluntarily. Then you couldn’t collect. They were so behind that they let many people collect who weren’t supposed to.

Customer
I told them when I applied that I resigned due to the circumstances I explained to you. I just don't understand why they would give something only to make the person to pay it back? That's ludicrous.
Customer
that's my fault? Just doesn't seem fair. What is this waiver you mentioned?
Customer
They're going to be calling me on the 28th bc I filed an appeal. I want to make sure I know what to say at that time.
Customer
You still with me?

I am so sorry. They did this to many people. It is a waiver to show that you can’t pay back the benefits because it will cause you a hardship.

Customer
I am definitely a hardship case. This waiver, I'm sure they're going to want that proof of hardship. Do you know what that consists of?
Customer
Hi
Customer
Are you still here?
Customer
Hello???

You would have to show that you can’t financially pay the unemployment benefits back. They could ask for income and expenses. You will need to ask for the waiver and then submit it, if they even allow you to.
