Good afternoon, how are you today?

Are you able to work with reasonable accommodations?

Customer
Not at the moment. Balance problems cause problems as um a security officer and need to respond to emergencies on the floor at our casino

Good day, here is the answer to your query. Please do not hesitate to ask any follow up questions related to this response and know that I will respond as soon as I can.

Under the Family and Medical leave act you are entitled to 12 weeks leave with job protection.

However, if you are not able to return, with or without reasonable accommodation, then the employer may terminate you.

You must ask for reasonable accommodation in writing.

If denied Accommodation or leave under FMLA, you need to file a complaint with the EEOC, www.eeoc.gov and also with the US Department of Labor, https://www.dol.gov/agencies/whd/contact/complaints

Customer
Thank you
Customer
Would any of those 12 weeks be paid?
img

LawEducator, Expert

The 12 weeks can be paid or unpaid, that is up to the employer.

They can make you use sick and vacation pay for the leave.

Customer
Thank you
Customer
I dont have either of those options open to me

You need to then take unpaid leave for up to 12 weeks and collect short term disability of you have that available.

Customer
My dr ask me to get paperwork at HR but does all employers offer short term disability to emplyees
img

LawEducator, Expert

No, not all employers offer it and it is not mandatory in NV.

You need to ask HR.
