JA: When did this begin? Was the work environment intimidating, hostile, or abusive?
Customer: It has been going on for some time, I’ve been doing good by trying to look over it. But it has come to the point where I no long feel safe working with the person.
JA: What kind of workplace is this (private sector, public sector, etc.)? How many employees?
Customer: I’m work for Honeywell, we are Sub contracted. It’s only me an the manager working at this site.

Customer: I’m just worried about my job, I get great feedback from the clients I work for, it’s just the manager I work with who makes my day bad.

What is an example of how you're being bullied?

It’s nothing is never good enough for the manager I work with. Being yelled at, treated unfairly, adding more work task so I can fail. I was in a bad car accident early this I ended up with a concussion, now those symptoms has come back due to all the stress I’m having at work.

I've talked to HR they have some insight on the situation. But it seems to get worse after I talk to them. Now he adds more on my workload like he is setting me up to fail. I have recording of how he talks to me and treats me. I haven't told them about the recordings yet.

Without the information I asked for, I can only give you a general answer.

I’m sorry to hear about your situation!  I have dealt with some terrible co-workers, managers, and subordinates in my time.  It’s one of the reasons I decided to become self-employed is because I just couldn't take it anymore.

Nonetheless, it’s important to analyze the law in this situation. Harassment/retaliation/discrimination is against the law; however, employment law only makes it against the law if the basis of these actions by the employer are based on your race, gender, age, religious affiliation, or disability.  Employment law doesn’t necessarily cover people who act like jerks.

In any event, there are some other things that I could recommend to you to help you deal with this problem now and not just in the courtroom based on my experience in working with thousands of people who have had the same issue.  Generally, I recommend that you keep documentation of everything that happened.

Also, I recommend building a support network and getting people involved in the situation who may be advocates for you.

Also, an employer can be held legally responsible for an employee’s actions when the conduct that caused the emotional distress is within the scope of the employee’s job, or the employer consented to the conduct through a term called “ratification”.  This means that if you can prove:

The employer had actual knowledge of the specific conduct

The employer knew the conduct was harmful

The employer failed to take adequate steps to remedy the situation.

You could also just sue the person individually who is causing you the emotional distress as well.
