Customer: i have a question regarding ui finding. I was let go from my position in late July of 2019. I also have a bar with another partner of which I did claim income from in 2019 via a K-1 in July. They have indicated that I do not qualify for unemployment any longer as I did not earn $1515 since I was let go in July of 2019. Does the K-1 earnings count for this? My self employed earnings were roughly 9K for 2019. However it is likely with the pandemic and mandated shutdowns that we will not make a profit this year. I do not take funds from the bar other than rent.
JA: Is your employer claiming the termination was for misconduct?
Customer: no...it was a reduction in force. I filed a new claim for unemployment last august. It appears to be the fact that I did not earn three times my weekly Unemployment within the year since i was terminated that they are denying my claim. The question is if the K-1 earnings would count?
JA: Where are you located? Unemployment law varies by state.
Customer: IL
JA: Anything else you want the Lawyer to know before I connect you?
Customer: I do meet the qualifying amounts with Q2/2019 $26915 Q3/2019 26,425.68 and Q4/2019 and Q1/2020 being 0. As I do not draw a paycheck I do not report any earnings to UI when I certify

I am very sorry to hear about this matter. If you worked in another capacity or had other income, you could very quickly be disqualified from unemployemnt.

I did not report any income to Unemployment from the bar as I do not claim a paycheck and with the pandemic it is unlikely we will make a profit this year?

question is...should I appeal the decision based on the earnings that were claimed outside of the last day worked for my prior job as sufficient for the 1515? I did not report as the earnings were not realized until July of 2020 when the taxes were done.

I would not suggest appealing the decision as you were not forthright in all your earnings.
