The law requires that they give him notice and a hearing (which they did) before expelling. Since that was the case, and since they still believed he engaged in misconduct, there wouldn't be a basis to sue them for a procedural violation.
The only thing that he could do is sue them for violating their own policies. This means that he would need to find proof that he was not masturbating at all. This means that he could sue the district and subpoena any of the witnesses to come testify to what he saw.
