Customer: My child was assigned female at birth, but considers themselves to be gender fluid/masculine. The public school they attend has a Senior Celebration, where couples walk and are acknowledged 1. They want my child to dress in a formal gown 2. They will only let couples walk if they are opposite sex and dressed as their birth assigned gender
JA: Where is this occurring? I only ask because laws can vary by state.
Customer: Longview, TX
JA: What steps have they taken so far?
Customer: They were told the "rules" yesterday in a meeting about the event. I'm reaching out for guidance on next steps
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: No. There's been no conversation or correspondence prior to this Not that I'm aware

Thank you for choosing just answer

To answer your question:

Step 1 should be to contact the school administrator and set up a meeting with them

img

Lawyerlady, Expert

Explain your child’s situation and see if they are willing to make an exception

img

Lawyerlady, Expert

If that does not work, unfortunately you do not have legal recourse in this situation. Meaning the school is permitted to set up rules for a dance. And as long as they are applying the rules to every person in the school, that is their right to do so

img

Lawyerlady, Expert

you can also contact the school district if the individual school doesn’t want to cooperate with you

Customer
It isn't a dance, it's a senior recognition night
img

Lawyerlady, Expert

The concept remains the same

img

Lawyerlady, Expert

unfortunately, they are allowed to set up those standards

Customer
Wow. So they can exclude students entirely because they don't have an opposite sex partner to attend a function with?
img

Lawyerlady, Expert

Essentially they are setting up rules and the students can either follow them or choose not to attend. Now as I said, you can always try to have a meeting with them. You could also consider consulting a lawyer about a possible gender discrimination suit. But in my legal opinion I do not think that is a strong case

Customer
It's a small town school district, they won't be open to exceptions. Even though they have a decent population of students who don't identify as cis.

I am so sorry this is occurring. I’m sorry I could not provide more positive news

Customer
Frustrating, but I realize Texas is not LGBTIA+ friendly. Thank you for your help.
