Expert's Assistant chat
Customer: I have a question regarding my daughter being cut from her high school volleyball team because she had a prior commitment that she made 2 months prior to knowing the practice schedule. I just wanted to ask a few questions about her situation to understand what my potential legal options are.
JA: What state are you in? It matters because laws vary by location.
Customer: West Virginia
JA: What steps have you taken so far?
Customer: I sent an email to the Principal, Coach, and Athletic Director requesting a meeting to discuss my concerns. As a result of my email a meeting was scheduled and I received a phone call from the athletic director where I voiced my concerns. We did not agree on an outcome and she still isn’t on the team. I still have a meeting scheduled with them on Monday.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I’m not sure how much detail you need but just from a high level standpoint my daughter has played for this same high school’s volleyball team for the past 3 years and has never had any issues with attending practice. This year at tryouts, before practices even started, she was cut from the team because she was honest with the coach notifying him that she couldn’t be one practice because of this prior commitment.

Do you feel your daughter was discriminated against based on her race, color, and national origin, sex, disability, or age?

Customer
Thank you. I appreciate your assistance. No, I do not think this was discrimination related.

OK.  Generally speaking, a school cannot discriminate against a student based on their race, color, national origin, sex, disability or age.  Schools must provide students with a reasonable education and follow individualized education plans.  However, regarding a student being cut from a sports team, if this was not based on discrimination, then it is likely within the discretion of the coach to do so.

Customer
I understand it's in their discretion to do so. My main issue is that they changed the practice attendance rules from prior years because they have a new coach but they didn't communicate those changes until tryouts. So essentially if I did want to pursue this legally, it will most likely not go in my favor?

Unfortunately, I cannot offer opinions on the outcomes of cases on this forum.  I do suggest that you speak with an education lawyer in your area for further guidance on this issue and possible representation against the school.

Customer
Ok thank you
