Expert's Assistant chat
Customer: My daughter was victim of bullying, harassment and aggression at school.
JA: What state is this in? It matters because laws vary by location.
Customer: NJ
JA: What steps have been taken so far?
Customer: I spoke to principal, counselor and superintendent. I have a report just stating that my daughter was victim of bullying but they don’t want to tell me what we’re the consequences taken to the 4 kids that bullying my daughter. This happened last June and they were in 5th grade. One of these boys kick my daughter at dismissal time and 3 parents saw everything.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I sent a letter to regular mail asking to have in person meeting with the superintendent and the principal of the school contacted my husband to let him know they can’t give us more information because they are minor and these kids are going to be in a different class during the school year. The incident was at dismissal, I am worry about my daughter because anything can happen during drop off at school, lunch or dismissal time. This bullying had been since September and the school didn’t inform me. On June, the counselor let us know about the other incidents that happened during the school year.

Is the bullying physical?

Customer
3 parents saw when 1 of these kids kicked my daughter but first this boy went on her back to pull her by my daughter’s bookbag to make her fall

I'm so sorry! As a parent, you can sue their parents for the assault.

Customer
She made a movement so she didn’t fall and the boy felt to the floor and start kicking my daughter while the other 3 kids were seeing everything. I had a meeting at school and my daughter told me that the kid kicked her before
Customer
the counselor just talked to him
Customer
They never reached out to me to let me know
Customer
When we wash the meeting my daughter told me she slapped the boy to defend herself because at dismissal the boy was following her and telling her to fight after she slapped him, the boy made 3 of his friends follow my daughter while she was walking and the incident happened. Another parents help my daughter because this boy didn't want to let her go
Customer
The school don't want to give me any information of the parents. I ask for a meeting with the parents and the school said they are not allowed to do that

Does your child know their child's name?

Customer
they were in the same class all year and they used to call her names

You may be able to locate the parents through an internet search. If you sue the school, you can also subpoena the info.

Customer
What is subpoena?
img

Elizabeth, Expert

It's a court order to turn over information.

Customer
I don't know what else to do to make sure my daughter is going to be safe at school. I would love to move her to another school but is only that one in my town. If I sue I need to pay for lawyers and is going to be expensive for me. I really don't know what to do. Something worst happened in another town with my older daughter in school and because I didn't know the laws my daughter suffered from bullying for 3 years and I just moved from town. I can't do that now
Customer
What is the best advice you can give me that I should do?

Have you been to the school board? The issue is that forcing schools to do things is often difficult without suit. You could also seek a juvenile harassment order to keep them away from her.

Customer
I sent a letter to talk in person with the superintendent and the principal of the school called my husband to have another meeting and she said already they can't give us any information about the kids or the consequences and the kids were move to another class but same school
Customer
Should I go to the meeting?
img

Elizabeth, Expert

It would allow you to speak in her defense.

Customer
Ok what should I do if they tell me the same? There is a report, my daughter was victim of bullying, the kids have consequences (they don't want to say what consequences because the boy who kicked my daughter the school gave him 1 day of school detention after school) and after I complained he was suspended for a day) and that's it. No more information

Rather than the punishment, you could focus on your child. What are they doing to protect her? Are they having monitors at dismissal? Keeping them separate at lunches etc?

Customer
Ok I'm going to ask that.
Customer
Thank you for your time
