At the next hearing date for arraignment, the state will list the formal charges that are being filed against you. The prosecutor will also provide you or your attorney with copies of any evidence that they have in their possession at this time. The good news is that since this is your first-ever criminal offense, you should qualify for enrollment in a pretrial diversion program. Diversion programs are reserved for first-time offenders only. They typically entail a probationary period, attending a victim impact panel, and completing community service hours. The charges against you should then be dismissed  upon successful completion of the terms of the program. You should be given an opportunity to apply for representation by the Public Defender's Office when you attend the arraignment hearing date. Their representation is income based, but they can let you know right away whether you qualify for representation. You can also consider contacting the South Dakota State Bar lawyer referral service for a referral to a reputable defense attorney in the area.
