Yes if there was perjury and you have definite evidence of the fact then you can get the restraining order dismissed.

Customer
my court date is on Monday next week. If I file a motion to dismiss will that extend the restraining order court date. Also I need an extended amount of time in court to be able to plead my case instead of the 5 minutes they usually give us. How do I do that?

Now look that depends on the court whether he will give you 5 minutes or some more amount of time to hear your matter. And if you file the motion to dismiss that may or may not extend the restraining order because it will be upon the judge to decide.

The particular that you hire will assist you in this. I am sorry to state that we do not provide this service apart from the legal advice.

Customer
That's vague and ambiguous. I need something more definite

The motion must include the complaint the evidence the facts and the prayer. But we don't provide the service of presenting you a format for the motion. We may only give you legal advice. Thank you.

Customer
Okay thanks. Do I need to serve the motion to my ex as well because some of the evidence has already been submitted and served in the last 2 years
Customer

JanLegal, Expert
