Customer: I have a criminal question question last night I was pulled over by major crimes supposedly because they said my car had no insurance I have an autolone on my car and in order to maintain that I have to have full coverage at all times itypes if not they'll come to repo my car so When I asked the officers why they were why they were stopping me if I for prefer had insurance they proceeded to tell me that they had they were waiting for a warrant to search my vehicle I'm on probation so therefore technically they don't need a warrant to search the vehicle and then so I get the warrant While I'm reading it I see the address that it instead it has as my address and that it's not my address for 1 for 2 it said that it is supposed to be executed in the Daytime there's no signature from a judge and There is no probable cause on why they're doing this. I guess my question is what are my options I was charged with possession and paraphernalia Even though the passenger in the vehicle had told them that it was hers and it was found underneath neither seat granted the car is my car I was the driver it is registered to me
JA: What was the basis for the warrant? Was there probable cause?
Customer: No that's what I don't understand
JA: The Criminal Lawyer will be able to walk you through that. Where are you located? Search and seizure laws can vary by state.
Customer: I'm in Utah county Utah I was pulled over in Provo improve but the warrant warrant is from orem
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I also had my pitbull in the vehicle and they brought a dog around the vehicle and they said that the dog hit on the engine Compartment

Except, why did they run your plate? If you had insurance, you can challenge the whole stop as lacking cause.

Customer
I don't that's what I don't understand and then so when I called him on me really having insurance Lawrence is when he said he was getting a warrant to search my vehicle
img

Elizabeth, Expert

Which makes no sense when there's no cause for the stop.

Customer
That's what I thought.
Customer

You can request a defender, http://www.avvo.com is also excellent for a private lawyer.

Customer
Ok. Do u think I could qualify for legal aid?
img

Elizabeth, Expert

Legal assistance usually only handles civil.

Customer
Dang ok. So what should I do next? I am on probation so I need to inform my PO but I'm nervous about doing that because because of the situation
img

Elizabeth, Expert

You would need to do so. You can be upfront, you could offer a drug test.

Customer
OK who would I do that too
Customer
I had barely checked in with my PO yesterday and did a drug test and passed
img

Elizabeth, Expert

I meant to offer to your PO, who has already taken it. You could ask for a copy of your results for court.

Customer
Ok. I'll do that.
Customer
Can adult probation and parole still violate me due to this situation
img

Elizabeth, Expert

They can since it's a new charge, but you can fight the violation.

Customer
