Customer: No...it happened last night. We did not receive a copy of any police report. The only way we found out that it was considered a potential DWI is that I have a friend who was able to access the incident record where it was noted as such.

I am sorry to hear your son is having some trouble.  Can you provide some additional information so I can better assist you?  You said one car accident- was anyone injured? Did he cause any property damage?

No injuries. He hit a guardrail on a relatively isolated country road and flipped the car. But was taken to the hospital for tests and released after several hours. The police interviewed him but he could not recall anything they said and I was not allowed to talk to the officers so I am at a disadvantage

Ok well as a first time offense he could if charge face a fine, license suspension up to 6 months and while jail time is a possibility, its very unlikely given the circumstances.  I would suggest that if he is charged, he immediately retain local criminal defense attorney to represent him.  That attorney is his best chance at negotiating for a lenient sentence/reduced charges.  He should not speak with the police again without an attorney present.

Thanks. And that's what makes this so concerning. The police could clearly see he was not remembering anything. He wasn't even sure he was driving as his Mother was with him. Not sure if the person who called it in said who was driving But the fact they didn't give him any paperwork or charge him at the time just is odd. What happens next. Do we just wait and see if someone reaches out to discuss any potential charges ?

It is a bit odd as the typical procedure would be to charge him then but yes I would wait and see what happens.  They could subsequently charge him by arresting him or sending him an appearance ticket directing him to appear in court.

You're welcome.  I would suggest he may want to do some research now to find at least the name and contact info of a local criminal defense attorney should he need it. It's best to be prepared.

An arrest is yes.  Jail is a possibility for a DWI under the statute. However if its a first offense, no other drivers were involved and no one was injured, he is much more likely to receive probation, community service, fines etc. It would be very rare for him to be sentenced to jail time.

Ok. Let's pray for that. He made a huge mistake and he realizes he messed up and is fortunate to be alive. I think it definitely got his attention and I just hope there is no additional long term baggage to overcome. Thanks for your time.
