Dan esq., Expert

Do you have the car?

Dan esq., Expert

That is horrible.

Customer

img

Dan esq., Expert

Did they give you a reason that they are trying to report the car as stolen?

Customer
they didnt do the paper work properly so the bank deny the loan
img

Dan esq., Expert

Oh that is not good. Do you have the bill of sale?

Customer
They want ne to return the car but i need to get my money back and also i cant return the car beacuse there no plate
img

Dan esq., Expert

img

Dan esq., Expert

Are they saying they will not return your deposit?

Customer

Customer

Dan esq., Expert

Customer
I got it on 1/7/22 and is out since 1/29/22
img

Dan esq., Expert

They say beacuse i kept the car for a month
img

Dan esq., Expert

Dan esq., Expert

If the paperwork gets straightened out if you get the funding?

Customer
but i talk to the bank and the bank wont give me the fund no more
Customer
Beacuse they say the dealership cant provide them with the bill of sale
img

Dan esq., Expert

This is an interesting one with a couple of aspects that have to be approached.

img

Dan esq., Expert

First and I think foremost is preventing any criminal issues.

Customer
My question is can they arrest me
img

Dan esq., Expert

Then worrying about the financial matters.

Customer
Is it a crime for not returning the car
img

Dan esq., Expert

As of right now maybe, of a warrant has been sworn out yes.

Customer
I cant return it without a plate
img

Dan esq., Expert

It is a crime to take a car, that they only received payment for.

Customer
But i didnt take why xant they just come tow it
Customer
i kind of beed my money too
Customer
What should i do
Customer
Should i just call the police and explain to them
img

Dan esq., Expert

That was where I was going. I suggest calling your sheriff, and explaining the situation, the confusion with the bank, that is their fault, let the sheriff know you are going to return it but the plate is expired, that they will not agree to pick it up and take possession. (They do not even need to tow, send two people over and have one drive it back).

img

Dan esq., Expert

Then ask the sheriff if a deputy will follow you to the dealership to vouch it is returned and allow the car on the road without a tag.

Customer
Ok thank ill the police
Customer
Ok
img

Dan esq., Expert

Then if they will not refund you, you have a small claims action for unjust enrichment to get the 2.5k

img

Dan esq., Expert

30 miles should not devalue a used car 2500.

img

Dan esq., Expert

But most importantly is making sure a warrant is not sworn out, and the car gets back with out issue, thus clearing you.

img

Dan esq., Expert

Having a deputy there as well can show proof and make sure the complaint or warrant is quashed. I highly recommend this. As following up with the sheriff to make sure the issue is closed.

img

Dan esq., Expert

Furthermore ask the deputy for a sworn written incident report, just in case a different agency or the courts system is slow in updating. Keep that on you as proof the matter is resolved.

img

Dan esq., Expert

Does all this make sense and can I help clarify anything further for you.
Customer
I try calling the police but no answer should i just get rid of the car so it wont be on my property
img

Dan esq., Expert

No I would keep trying to call law enforcement until you get hold of someone. Ditching the vehicle makes you look real bad

Customer
Beacuse i dont want them to show up and arrest me for nothing
img

Dan esq., Expert

Well you have valid defense, at this moment. If you are going to ditch it, and drive it take it to the dealership.

Customer
Im not trying to go that far im just going park around the block
img

Dan esq., Expert

Well right now you are 100% liable for the car, and any damage. I do not recommend that.

img

Dan esq., Expert

In fact law enforcement likely has your address from the documents you filled out with the dealer if they are going to arrest you they will find you.

Customer
I saw them drive pass my house couple time on my security camera
img

Dan esq., Expert

Ok and did not execute a warrant. I would keep calling the police and the sheriff until you get hold of somebody.

Customer
Ok
img

Dan esq., Expert

Is there anything else I can clarify for you

Customer
No thank you so much
