We are a small business in KS and want to respond to a Florida bid. It contains the following language: Pursuant to Section 287.084, Florida Statutes, relating to the Florida-based business preference, effective
July 1, 2012:
In a competitive solicitation in which the lowest bid is submitted by a vendor whose principal place of
business is located outside the state of Florida and that state where the vendor’s principal place of business
is located does not grant a preference in competitive solicitation to vendors having a principal place of
business in that state, the preference to the lowest responsible and responsive vendor having a principal
place of business in this state shall be 5 percent.
Note: The Vendor is MUST complete and submit this form with its bid. Failure to submit will result
in the vendor being found non-responsive.
Vendor Name:
Vendor FEIN:
The Vendor (does ) (does not ) have a principal place of business located in the state of Florida.
If so, please provide an address:
Note: Pursuant to Section 287.084(2) A vendor whose principal place of business is outside the state of
Florida must accompany any written bid documents with a written opinion of an attorney licensed to
practice law in that foreign state, as to the preferences, if any or none, granted by the law of that state to its
own business entities whose principal places of business is in that foreign state in the letting of any or all
public contracts. Failure to submit the written opinion will result in the vendor being found nonresponsive. My question is, what would it cost to get a letter as mentioned in the last paragraph.
JA: The Expert's answer will cost $10 to $100, depending on the issue type and time to respond. You'll see the exact amount on the next page and can decide then. It's way less expensive and more convenient than any face-to-face visit.
Customer: I'm not sure I understand...the next page of...?
JA: The Criminal Lawyer can help you with the statute of limitations for solicitation. Before I connect you, is there anything else you'd like them to know?
Customer: This is not a statute of limitation question, and I'm not sure a criminal lawyer is appropriate. I do need a KS lawyer, though.
