Customer: Someone has fraudently accessed one of my credit cards as a credit counceling agency, worked with Synchrony Bank who holds the card in my name, established a payment plan and reduction of interest charges and had my PayPal Mastercard CLOSED. i gave noone the authority to work on my behalf verbally or otherwise. I can't affort a lawyer and the Synchrony Bank will not send me a copy of this letter they have on file.
JA: What state are you in? It matters because laws vary by location.
Customer: Oregon
JA: What steps have you taken so far?
Customer: I have talked with Synchrony Bank 3 times now. They won't send me a copy of this letter. I did get some info from a rep named Lov. She said the company was Town and Country Credit Services. There is only one by that name online and they are located in Alabama. I called them and was told they don't have any such account with my name or even a like name to mine. They also told me they don't work with PayPal at all.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I am retired and can not afford legal help. Once a Paypal account is closed it can not be reopened. This account had years of good standing. No Past Dues and no Late Charges. My Credit Score has dropped 39 points since Saturday. I would like to seek restitution for this FRAUD.

I will give you my suggestions.

You have already taken important first steps in contacting the credit card company.

You should also send them a letter by certified mail return receipt requested to the address on their statement, disputing the charge and indicate why. They will then investigate. You should also do the same with your bank since the money will be deducted from your bank account. You should also file a police report and notify the State Attorney General's Office of the fraud. Make sure your credit card account is closed and that a new one is opened. You can also file complaints at the OCC https://www.helpwithmybank.gov/file-a-complaint/index-file-a-complaint.html which monitors banks and at CFPB https://www.consumerfinance.gov/complaint/ which monitors credit cards. Also contact the credit reporting bureaus and tell them you dispute the credit rating drop since there was fraudulent activity which you are trying to resolve and ask them to investigate as well. You can file a claim with the bureaus. If these avenues do not work out, you can send a demand letter to the credit card company and bank demanding they put the money back on your account immediately or else you will take legal action. You can then sue in small claims if the amount is under the cap. to get your money back.

If you follow the above approach, you should be in the best position to get satisfaction.

Customer
This has nothing to do with my bank. The payment arrangment made by this so called service is to Paypal and they had the account closed. You don't seem to understand the issue. Someone decided to negotiate terms to one of my Mastercard Accounts without permission and then had the PayPal MC CLOSED.

Ok. Synchrony Bank is affiliated with your credit card?

img

GAL, Expert

If the person did not have authority, then there was fraud involved.

GAL, Expert

You should follow my suggestions above as it applies to your master card.
