Customer: Hello. I am looking for someone to help me with a consumer fraud case. I bought a 98 Dodge Dakota, June 21 from a man that owns Midas. I figured with that name he would have standards and would not rip people off. After I tagged and insured, I drove it to Tucson Az about an hour and a half away. On the way back I started having trouble and had to have it towed back to their shop. A few weeks later they took the transmission to another shop for repairs and they said that the damage was not my fault because it was completely dry of fluids and has not been maintained in a long time. I ask the previous owner for my money back or some compsentation because I already paid him 3800$ and the transmission is going to cost me 2500, he is selling his business and will have it sold by the end of the month. Can you help me?

Customer: Yes I have been to his shop and I have three emails and have a statement from Kellys Transmission from this same area.

Customer: At his shop that he is trying to sell all of the legal pot plants around the property have been cut down so it can be sold I have photos of them. It may not help my case but he has not taken responsibility for what he sold me. He knew what he did.

Hello and I do have legal questions. June 21 I bought a 98 Dodge Dakota for 3800$ On the advertisement he indicated the milage, new battery, new clutch kit, new tires, those were obvious, new battery and belt s, I was not shown any paperwork or documentation. I did the legal stuff, insurance and registration, tags to drive it. I drove it to Tucson which is about 1.5 hours away from here. On the way back it was acting up and had to have it towed to there shop. After a few weeks they took it to a local transmission shop. When I went to Midas where I bought the truck they were very intimidating to me telling me that they all drove it but they never fixed the problem. They would not refund my money and tried to blame it on me. The owner of the transmission shop said it was not my fault because the transmission was completely dry and had not had any fluids in it in a very long time. I invited the man that owned Midas, the man that sold me the truck to go look at it. It is October he is selling his business. He has more than one in the same location. It will all be sold in just a few days. What can I do get some kind of compensation for all of this? He has not been fair.Also l have emails of my conversation with him.

Unless this is covered by a warranty, meaning you bought a warranty or there were specific statements saying this kind of problem would not happen in this time-frame, then the car was "as is" or without a warranty and that means you assumed the risk that this would happen by not allocating that risk to the seller by paying for a warranty.

Didn't want to hear that. There was no warranty but I was hoping that he would be fair to me in this transaction.

Did he assure you that the transmission was good? If not, you don't have a case.

Well in the email he sent me he said everyone in the shop drove it to ensure there were no problems and that they checked there work and made sure all fluid levels were correct. But they were not correct, at least the transmission level weren't. The owner at the transmission shop said it could be drove around the local streets and everything would be fine for a short time but once it was driven on the highway because of the lack of fluid it would break down. I still have the email.

That email could be construed as a warranty, but it's a long shot. How much would the repairs cost?

I was thinking the same thinking, maybe 3k, thats parts and labor ball park figure. He owns Midas and two or three other business

Sueing over about $3,000 is not that much and I would not recommend doing so under these facts. If he will perform repairs or contribute towards the repairs. I would accept such an offer

I would too. They have not worked on the truck yet. When it's done maybe I can talk to him again but don't think will.
