Expert's Assistant chat
Customer: My house got flooded almost year ago, The cause was due to the storm drain. MWA have back and forth about them repairing my house. Now they tell me that was no longer involved because they filled with the insurance and they refused the claim. How do I file a complaint on the city. I have pictures of my home. I told them in August of 2021 even the Mayor. Then my home flooded in October 2221
JA: What steps have you taken so far? Have you prepared or filed any paperwork?
Customer: Yes Mrs Paris sent Desmond Brown to my home the day of the flood and he filled papers and took pictures. I have been to MWA meeting. They were just trying to get to him I have talked back and forth with Sam Hart when he was on the board. I can do better if I can talk with someone. I am 69 and live along
JA: Have you talked to a French lawyer about this?
Customer: What is that I don’t want to sue I just want my house fixed
JA: The Real Estate Lawyer will be able to walk you through that. Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: My house got flooded about four years ago that is why I kept watching the storm and they would not do anything i had to put carpet back in my home and fix the walls. The storm drain do not even sit on my property

I am so sorry to read about this flooding.  Do you have any professionals able and prepared to provide evidence - if you do sue - that the cause of your flooding was the city's storm drain?

Wow, that is quite a flood.  Were you ever provided the contact information for the city's insurance company that has since denied the claim?

Customer
No Joey only text me because I kept after him because it two months before he text this, He told me the insurance was Travelers. I am sending you his text

Did you report the damage to your own insurance company?

Customer
Insurance claim was denied. There is no further involvement from the insurance company or the MWA.

So was that your insurance company that denied the claim, not the city's?

That is a difficult position and one it sounds like your only hope of having someone else pay for the damages would be to sue the city.

The evidence you will need to have any chance of success in such a lawsuit is that the city was negligent in maintaining or constructing the storm drainage, that that negligence caused this flooding (versus super high rainfall), and that the flooding caused damage to your house.  So, these cases can be difficult to win.

In addition, claims against a government have other hurdles you must overcome. Can you confirm for me again in what city and state this happened and I can pull more information on what might be required to file a claim against the city.

They had my daughter and me to speak to an attorney David Cook last year but He had me thinking they were going to help me

I am sorry to hear that was the case.  Has anything been done to fix the drainage to avoid future problems?

Customer
One of my neighbors was helping me to keep watch on the storm drain that is why in August I sent theta letter, I sent a letter to Major Miller in October I called his office the day of the flood trying to get the flood stopped by cleaning it out . His office told me it was not responsibility
Customer
I meant I sent him a letter in August and called his office the day of the flood to get the Macon Water Authority out here to stop the food

I am sorry that no one is willing to help address this issue, as until the drain is properly cleaned out and maintained, you are apt to continue to experience some flooding in heavy rains.

If you can tell me in what city and state this is occurring, I can send information about what it would take to sue the city.

Customer
Mr Brown was sent out by our representative Mrs Paris because I had contacted her both times
Customer
Because of what happened they are charging 4.99 a month to keep the storm drain cleaned but I have not send anyone out there

The state and any city in it can be sued but there are limits.  This website does a good job explaining how you can pursue the city for property damage claims:  https://www.pagepate.com/experience/civil-litigation/georgia-torts-claims-act/
