How are you doing today? On review of your facts, I recognize that this is a difficult and sensitive situation. I intend to guide you in the right direction.

My understanding is that there was a waiting agreement with partial payment.  Was it in writing?

Customer
I requested in writing but they insisted to get the money first

After consideration of the information that you provided I am ready to provide you with an answer to your question.

As a reminder, after you review the answer, you are welcome to reply back with any follow up questions.

The arrangement is binding, but you need to prove the terms and that they agreed to hold off.  That can include e-mails, texts, and even witness statements.

Customer
Well I do have A witness the original seller Dwane Coffee. He helped me it started I wNt $10,000.00 by tomorrow. I told the office manager Kerren since Randy was no longer available that I am in a loan process and give me more time that was last Thursday. The loan process is still not finished but I am getting the money. They knew every step I was doing. I said I need something in writing that you will wait for the money but I just got $2000.00 from my broker I'll give it to you as a good faith gesture so you know I am getting the money. Offi e manager said ok. I never got the letter and I gave them the money. Dwane sent me a screen shot that said gi ahead and sell the equipment. I haven't closed the loan still working to finish today I think. I tried to talk to him and only left message after message. He was unfair to me going threw COVID 19 it's ironic after he said ge would work with me.

I would threaten and consider complaint to the attorney general and the BBB.

It helps to prepare your case with a good narrative or story of what happened. This helps focus the presentation of the facts and arguments. It is often useful to have a chronological timeline of events with facts and back up evidence (e.g. e-mails, texts, photos, witnesses)

In your situation, I also think that you would benefit from local representation. www.justia.com/lawyers and www.avvo.com are both excellent resources that let you find a local lawyer by location and practice area.

You can also use a local consumer lawyer.  In your situation, I also think that you would benefit from local representation. www.justia.com/lawyers and www.avvo.com are both excellent resources that let you find a local lawyer by location and practice area.

Customer
If I had more money I would do a phone call with you sorry. This is frustrating. The Consumer Protection said they can't help me too.
