Customer: My friend is staying in a Homestay with a family. Here room is in the basement. Last week she had to use the bathroom and went upstairs at 1 am and when coming back down the stairs she tripped and broke her ankle and is now in a walking cast for 3 months. The stairwell has no railing and there is no light to illuminate the area at night. The landlords are unwilling to help her get to and from school or compensate her in anyway for her losses. She is having to take UBER to public transit and then an UBER from the station to school. She has asked them at a minimum to either give her one month free rent so she can pay for her transportation costs or to use her car to drive her to and from school. Does she have any recourse to mitigate her financial losses?

Hi,, sorry to hear about this situation.  What province are you in?

She can certainly bring a claim against the landlords for personal injury but it won't happen quickly enough to resolve the issue of her getting to school.  While she's here I suggest she make her way to a personal injury lawyer.  Is she willing to come back to pursue a personal injury lawsuit?

Would this be resolvable in small claims? She is here for two years so she has time to pursue this.

She has paid $1500 in medical bills as her medical insurance does not start until March 1. The landlords have house insurance but I don't know if they would be willing to make a claim through their insurance company

Yes you can bring claims up to $35K in BC in small claims court.  I suggest she try and move if she is going to sue them soon because if she is sharing a kitchen/bathroom with the landlord she is not protected by landlord tenant legislation and they can throw her out with little notice.
