Alex pays me as per the shared house living agreement that I sent to you. He is not a tenant He is only an occupent

Because this person shares the accommodations with you they are not covered by the residential tenancies act. That means you do not need to get an order for eviction.

Even if your agreement was for  a fixed term agreement this tenant has breached the agreement with you by acting in this way. You have a legal right to peaceful enjoyment of your home.

You can give the tenant something like to the end of this month to get out and tell him if he fails to comply you will take legal steps to have him removed.
