I have been in contact with Canada Transportation Agency and with Westjet Airlines trying to get reimbursed for flights

Expert's Assistant chat
Customer: I have been in contact with Canada Transportation Agency and with Westjet Airlines trying to get reimbursed for flights cancelled by Westjet in December 2020 back to our original method of payment. It has been a frustratingly slow process and we still have not been reimbursed and have only recently been informed by Westjet that I am still in the cue although my most recent complaint forms to them were received by Westjet Sept 2021. Our original complaint to Westjet asking for reimbursement was at the time of the flight cancellations in December 2020. I feel that they are delaying our reimbursement until we run out of legal time to receive one. What more can I do to get this taken care of sooner than later?
JA: Have you contacted the seller or manufacturer?
Customer: Yes
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I don't believe so

I know your question is important to you and I will be giving it the time and attention it deserves.

Sometimes responses and replies take time, so I ask you to be courteous and patient to allow me the time to type answers to you and also to others. At times I may even have to do some research.

I am sorry to hear of this difficult situation.

Well you certainly reach the right expert because I have been dealing with exactly this issue.

I have one question. Did they actually cancel or did you know that they were canceling or the government changed their policy again so you canceled first?

Customer
Westjet cancelled the flight

Here is the answer to your query. Please do not hesitate to ask any follow up questions related to this response and know that I will respond as soon as I can.

If worst comes to worse you can sue them in small claims court and self-represent. You have two years to sue so it won't be too late.

As well, you will find out that  the Canada transportation agency will actually get back to you and will actually communicate with them for you. If they don't get this resolved you can go to arbitration with the Canada transportation agency instead of doing small claims court. They actually advise small claims court because they believe small claims court will be faster. Their arbitration hearings are not happening for at least a year. I'm not sure if small claims court is faster.

At the end of the day you will get your money one way or the other. The time is not running out yet.

Does that help?

Customer

To tell you the truth I was shocked at how good the person was who helped me with the CTA. He was extremely efficient and very thorough and extremely kind. I was so surprised!

Customer
I am waiting for a call from CTA this week as I believe Westjet has lead them to believe that this matter was settled?! Not sure why they did not contact me to confirm this was the case but I will prefer speaking with someone rather than the back and forth emails that always have processing delays. Thank you so much for your assistance Debra. I feel more confident in a fair resolution now.
