I am in BC. This is Victoria Prendergast and this is a follow up question regarding out existing text thread regarding me and my strata council retaliation for posting a you tube video of my council hearing. Is it illegal to upload a LEGALLY recorded council hearing to yourube?

When I first posted the video a couple different council members called me asking me to pull it down and passing on off the record info that the president of council may sue me if I dont pull it down.

I know the video was legally recorded. I have that right under PIPA legislation. But that legislation does not talk about uploading youtube videos. Their argument was that I uploaded video of a private council hearing without their permission.

Do I need their permission to upload a legally recorded video of my council hearing? (keep in mind the video ONLY covers matters relating to me. The video exposes shows procedural unfairness in the council hearing. The video exposes flaws in the CRT hearing that ordered 8 million dollar special levy. Which is why I am calling it a whistle blower video.

Jihad should not even be allowed to speak because it is a conflict of interest. His company is a direct beneficiary of the Special Levy project that I am arguing is illegal. When I was on council I make it clear that I wanted to fire Jihad's PM company and replace with a new one that would follow the rules. This is why they have a Vendetta against me.

If everyone knew that you were recording and they went ahead then the recording is not unlawful in the sense that it's not a criminal code offence to record them. That doesn't mean that you have the right to post something on social media that os supposed to be confidential and so while they wouldn't be able to have you charged they could sue you and they could get an order to have you stopped. They could also consider it harassment. You aren't free to do whatever you want just because it's not a criminal code offence.

Do you see what I mean?

A - No one is disputing if I was allowed to record it. The PIPA legislation states that I am allowed to record a council hearing, even without their consent. (they did not give their consent but they also never said I am not allowed to record. But they couldn't have said I am not allowed anyway because the law allows the recording.

Q: If I am limited to using the CRT to sue them for violating my rights, are they also limited to use the CRT to sue me for this video?

That's an interesting question and I'm actually not positive of the answer but I believe that you would have a good argument to make that they have to see you at the CRT.

However, if they were suing you for defamation they have to sue you in Superior Court. The other courts do not have jurisdiction over defamation matters.

Wynoford is an international company with headquarter in the USA. They offer property managemtn services to many strata and non strata groups. My video and the evidence I was trying to read out, and the inforamtion int the video decription points out Wynford wrongdoing. What to you think of a "public interest" defense argument? You know, exceptions for publishing information that would normally not be allowed, but is allowed because of the public interest. Any public watching this video may be able to make a more informed decision about hiring that company, so it is in the public interest. You know what I mean, whistle blower protections maybe etc?

The video is not altered, it is simply the actual video of my sham hearing, dominated by a conflict of interest PM. There is no commentary of me insulting anyone. I think the defense to slander and defamation is the truth right? If something is true it is not defamation right? Considering my comment, since the video shows the exact truth of the hearing, would you agree that I could not be sued for defamation?

Ok next part of this..... I did insert a thumbnail before the video. I put a crown on Jihad's head. This was not just random. This was in direct response to the fact that he acted like 'king of the council hearing' and because his attitude was entitled, superior, above the law. In the video he spoke crazy words like a king above the law.... "you will not....you may not get an answer in 7 days. You will get an answer but it may not be an answer to your question." Our group of strata that he manages IS called Woodcroft Estates. And the way he has ruled rough shod over the rules, breaking laws... the way he lied to 1200 owners that the city was going to shut us down if we did not vote the way he wanted on 23 million dollar make work project that his company gets some money from. The way he is sneering me in the video. It all adds up to my putting a crown on his head. If thy tried to sue me for defamation for the crow on his head, do you think my argument that "it is appropriate feedback to his kingly actions be a defense against slander? You know, back to the defense of slander is truth concept?
