He was found unresponsive at his place and was hospitalized, is that legal for them to do?

This is a blatant case of discrimination. This is contrary to the human rights code.

For now though, your son must go to the union. The union have to represent your son and fight this. If the union cannot or will not do that then your son can file a complaint with the human rights Tribunal. But they won't take his case unless he shows them that the union cannot or will not help him.
