Customer: hi, ive just had an arguement with the occasional maintenance person who looks after the property i live in who is also the uncle of the tenant below me. it was about a plant the landlord gave me that i have sitting on the ledge of my balcony both weighing 7.118lbs each with dry soil. (his staff hes working with that would be his witnesses to this dispute are family also along with a drug dealer, that is a trigger for me as im a recovering addict and also stole parts off my brand new ebike last year) he was yelling at me about how these plants if they fell, would kill his niece aka the tenant below. i asked him to stop yelling at me because its unprofessional and he got more upset to fight that he wasnt. i went inside befor it escalated but approx fifteen minutes later, i went out and moved the plants in question to the other side of the balcony. they have now gone to get an eviction notice based on endangering t
JA: Because laws vary from place to place, can you tell me what state the property is in?
Customer: another tenants life
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: ontario
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: theres a bunch of stuff as i used to work grounds for her also and wasnt paid for my last work. the electrical in my unit and i would assume all units based on lack of upkeep is hazzardous and upkeep of things when ive notified them theres work to be done has not been done. i gave up five years ago as ive been here for seven and started fixing things out of my own pocket to avoid the typically blame i get from the landlords nurse. should i contact property maintenance also im wondering.

Here is the answer to your query. Please do not hesitate to ask any follow up questions related to this response and know that I will respond as soon as I can.

In terms of a notice of eviction, they have to give you seven days to rectify the situation and you've already rectified it by moving the plants back so they can't evict you for this reason. It's nonsensical if they think that they can.

But really, the other issue is that they are depriving you of your right to peaceful enjoyment of your home. For this reason it may make sense for you to take them to the landlord and tenant Board for an order requiring them to give you  peaceful enjoyment of your home and for a rent abatement because they have been depriving you of this right.

In my view your best next step is to contact the landlord and tenant board, call first thing tomorrow morning so you can get through, and discuss this issue with them and ask them how best to proceed given the Covid backlog because you can't live in constant fear of harassment. This is your home!

Does that help as a starting point?

Customer

You will not be able to get a hearing for a long time most likely so you need to start the process immediately. I really urge you to call the landlord and tenant board right now if possible and otherwise very first thing tomorrow morning so you can get a better understanding of what you need to do and when.

Customer
