Hello my name is Erica. not really just couple of guitars, furnature and movies. he was on ODSP so there is only a couple hundred in his account

my son was left next of kin but there was no will. without an executor we can not get access to his apartment to clean out his stuff or close out his phone, cable or anything.

You won't be able to become executor of the estate because you're going to have to apply to the court and it's not that you wouldn't succeed but that it will take a long time and it's very complicated if you don't have a lawyer. There is no estate in fact.

I suggest that you and your son go over to the apartment and indicate that your son is next of kin and you are his guardian and together you need to get access to the unit so that you can get out your son's items.

You can tell the landlord that you are willing to take on some of the responsibility of cleaning out the unit because otherwise the landlord is stuck with it. You can tell the landlord that your son's father was on ODSP, has no estate, has no one to do anything except what you're willing to do.

If that doesn't work why don't you call the police and see if they will help you get into the unit so your son can take the things that he wants such of the guitars and the movies etc. if none of that works perhaps you have to pay a lawyer to send a letter to the landlord.
