My roommate and I are currently looking to sublet or assign our unit to someone else. We signed up the lease with the landlord which is the building company for 1 year and we have paid 6 months rentals before we move in. So far, we have lived there for just 1 month but we decide to leave the place and terminate our lease by subletting or assigning, which is acceptable based on the lease terms.
To break a lease early, you have 4 options:
1. Come to an agreement with the landlord to end it
2. You can sublet your lease to someone else (with landlord’s permission)
3. You can assign your lease to someone else (with landlord’s permission)
4. You can go to the landlord tenant board and ask them to break the lease early and provide evidence that the landlord substantially breached your rental agreement
When it comes to subletting, the landlord cannot unreasonably deny a sublet request. If they do, then you can go to the landlord tenant board and seek an order to terminate your tenancy.

We have found 2 girls who are also international students as my roommate and I am and they are willing to take over our lease which is a great news. However, when we talked about it to the property manager and provided her all relevant materials of those 2 girls like copies of passport, study permit, visa, and offer from school, she questioned the credit standard of those 2 girls because they are international students without any income or sponsor in Canada. However, since my roommate and I have paid 6 months rentals already with 5 months rentals unused, I do not see any point of risk. Also, we promised her that those 2 girls will give her additional deposit checks for 6 months, but she questioned: what if their checks are void?
If you want to assign it to them (they legally take over your lease instead of a sublet which is a temporary take over) and the landlord unreasonably refuses your request, then you can serve the landlord with a 30 day notice to end the tenancy under s. 96 of the Residential Tenancies Act.

I can understand her concern about default risk from people without income or local sponsorship, but I do not see it is possible for those 2 girls are willing to or able to provide additional 6 months rentals because they will be charged for 11 months prepaid rentals before she move in. The rental is as expensive as 3,550 CAD per month and I do not think anyone would pay for 11 months for that before they move in. As a result, if my property manager or landlord insist to charge them 11 months prepaid rentals for letting they move in, could you please advise if that is sort of unreasonable request?
If they don't have an income or credit history, then they could ask for a co-signer, proof of family support or perhaps prepaid rent. If they are offering the cheques upfront, then their risk is lowered.

if those 2 girls are able to provide family support proof even from another country and offer cheques upfront, then they should be thought of as reasonable tenants, do they?
It would suggest that they would make for reasonable tenants on a financial basis.

Because what my property manager kept telling us is that she does not think those 2 girls have a qualified credit standard because they are international students, and she said if they can give some upfront money, they that would be great. However, those 2 girls will have to pay my roommate and I 5 months rentals before they move in because those 5 months rentals have been paid and covered by us. So if they are asked to pay additional money to the property manager, that means they might need to pay many many months rentals upfront, which is almost impossible for them.
5 months upfront seems sufficient, in my opinion at least.

if my landlord will not accept those 2 girls unless they can pay like 11 month rentals upfront which is a huge amount of money, would it be viewed as unreasonable refusal? Thank you!
If they refuse, then you can serve your notice to end the tenancy. The landlord could either accept it, or challenge it at the tenancy board.

I have no way to find anyone who can offer that huge amount of money in the world, I believe.
It seems excessive given several months are being paid up front.

The property manager suggested us that that is one of options for us to simply serve them the notice of termination, but they will not give us back any money we have paid.
You would need to request it back. If they refuse, then you would need to go to the landlord tenant board. This could take some time to get a hearing date.

I have a question on my lease assignment. Actually, there are 2 girls on the lease: I and my roommate. I certainly want to leave the lease by assigning to another one and I made the request last Tuesday to the property manager.

However, I have not got any response yet. If I will not have got any response by tomorrow, that means I will not be responded within 7 days after I raised the assignment request. However, since I am not so sure about how my roommate thinks of, I do not know for sure if she also wants to leave the lease. If it is just me who serve the property manager the notice to terminate, is that legal since there is another girl on the lease who might not want to leave the lease. Thank you!
I think you should speak to your roommates and let them know that you will be leaving if you cannot assign a person and they will lose all say in who their new roommate will be. That might prompt them to work with you to find a solution.

You could do that, but your roommate will likely oppose this if it were to go to the landlord tenant board.
