Expert's Assistant chat
Customer: I'm hoping someone can help me. I have a Human Rights file going to conciliation on Thursday this week and have been asked what I expect to get out of this as an offer or otherwise. I have no idea how to answer this, or what would even be reasonable
JA: What state are you in? It matters because laws vary by location.
Customer: I'm actually in Alberta, Canada
JA: What steps have you taken so far?
Customer: I have filed the complaint, the respondent has submitted a response. I have submitted a rebuttal and now it's going to conciliation
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I really don't have any idea what I would need to inform them of.

Hi can you tell me a little about your claim so I can help assess what your demand should be?

Customer
I can. What in particular do you want to know?
img

ARLENEP41, Expert

What is the claim about?

Customer
I am a severe brittle type 1 diabetic. I provided the company my employer sourced this out to, with letters from a physician and a specialist stating I am no longer able to work at all. My employer never got this and is trying to say I need to return to work. I told them if they put me in a position where I'm FORCED to quit due to health I would contact human rights. My employer cut off my disability benefits as if Nune 15. 2020

I'm very sorry to hear about this situation.  So, you want accomodation and 'emotional distress damages'?

Some examples of remedies include money for loss of wages or injury to dignity and self-respect, an apology, a change in policy, or participation in a human rights education activity.

Customer
I want something to happen with my employer re: how they treat situations like this. Rather than just tell me they can't talk to me at all about it or receive my documents directly, I feel they should at listen listen to what I say and then follow up with who they hired. I'm also confused about what amount I can reasonably ask for because I was approved both for COP Disability and AISH. Both government agencies who have accepted my disability. All of what you mentioned sounds like what I should be looking for. Just confused about amounts that would be deemed reasonable

ARLENEP41, Expert

Well, you can  ask for injury to dignity and self respect in the $30,000 range.

Customer
Ok. That helps. What would you say about the rest of the options?
img

ARLENEP41, Expert

It doesn't sound like there are lost wages maybe a loss of benefits if you were entitled to more income replacement from their disability carrier.

You can just ask that the employer attend a reeducation program regarding disability and accomodation

Customer
Ok. Not really a loss of benefits because my benefits are still in place for the time being. However, my employer is trying to come after me for their portion of my monthly benefits payments. They told me my payments would start as of June 15 2020, my employer had continued to pay on my behalf in good faith and on that date the amount they want from me was $6250.00. They asked if they could start debuting my account monthly for this but I refused to allow it

I would definitely raise that issue at the conciliation.  Based on what your telling me I don't see why you would be required to pay their portion.

Customer
I couldn't see a reason for it either. Just nice to know I'm not out to lunch on that. There is one other issue I have with this. Human rights has advised me that, other than my husband, I am not allowed to discuss this matter with anyone else - they don't want other people influencing anything. However, I am also in a lawsuit against the company my employer hired for this matter. That lawyer asked if she could see any offer before I sign just to ensure there isn't anything that will hurt my lawsuit. Would there be any reason human rights is able to advise me this is not an option?
