Customer: I just found out yesterday that there were two wills made from the same person and that in the first one the human society and the happy liver society were the benefactors in the second will dated the next year neither were listed the second will was written on her death bed and she was not of sound mind. also her sister would like both wills thrown out and the estate to go to her instead she is not part of either of the wills

Good afternoon– sorry to hear about this situation. Generally speaking, the last written will would be the one which would govern the deceased’s estate. If a party wants to challenge it, then they should retain a lawyer. They would need to prove that the deceased was not of sound mind or was coerced into signing it. Should that be the case, the will would be discarded and the first one would be used.
